Terms and conditions

These terms are an agreement between you and [Legal entity name] ("we"), operator of Real Estate Agent Email Lists. By buying a file, starting a subscription or using the site you accept these terms, the acceptable use policy, the privacy policy and the refund policy. If you buy for a company, you confirm you can bind it, and "you" means that company. You must be at least 18 and buying for business purposes.

We sell two kinds of product:

• One-time files. A state file, any combination of state files, or the USA bundle of every state and DC ($899). A one-time purchase is the edition current on your order date. It does not change after you buy it and does not include later editions.
• Monthly updates. An optional subscription, priced at 10% of the one-time price per month, that adds each new monthly edition of the same files to your dashboard while it is active.

Prices are shown in US dollars before checkout and are the prices you pay, plus any sales tax shown at checkout.

The files remain our property. When your payment clears we grant you a non-exclusive, non-transferable, perpetual license to use the edition you bought, and each edition delivered under a subscription, inside your own business. You may load the data into your own CRM, email platform and dialer, share it with your employees and contractors who work on your campaigns, and keep it after a subscription ends.

You may use the data to contact licensees about products and services relevant to their work, for recruiting, for market research, and to enrich or check your own records. Every use must follow the acceptable use policy, which is part of these terms.

You may not:

• sell, rent, license, give away or publish the data, in whole or in part, or include it in a product, database or list that others can access;
• use it to contact anyone about matters unrelated to their real estate business, to harass anyone, or for any unlawful purpose;
• use it to decide anyone's eligibility for credit, insurance, employment or housing, or for any purpose covered by the Fair Credit Reporting Act;
• contact anyone who has asked you, or us, not to be contacted;
• try to work around download limits, share sign-in codes or let others use your account.

You are responsible for your contractors' use of the data.

You are the sender of every email, call and text you make with the data. You are responsible for following the CAN-SPAM Act, the Telephone Consumer Protection Act, the Telemarketing Sales Rule, the National Do Not Call Registry, state telemarketing and data laws, and the rules of your email and phone providers. Phone numbers are typed as mobile or landline where we can tell, but you must scrub them against Do Not Call lists and get any consent the TCPA requires before you call or text a mobile number with automated tools. Payments are taken by Stripe. Files are delivered as download links on your dashboard and by email as soon as payment clears, in CSV and XLSX. Download links are signed and expire after a short time; you can generate fresh links from your dashboard whenever you sign in. Keep your own copy: we keep editions available to download, but we do not promise to host any edition forever.

A monthly updates subscription renews each month at the price shown at checkout until you cancel. You can cancel at any time from your dashboard or by email; cancellation stops future charges, and the current month runs to its end. Months already billed are not refunded. You keep every edition delivered while the subscription was active. If a renewal payment fails, new editions pause until it succeeds. We may change the subscription price with at least 30 days' notice by email, and you can cancel before the change takes effect.

Because files are delivered instantly and cannot be returned, all sales are final. A free 100-row sample of every state is available before you buy, in the same format as the full file. If more than 2% of the emails in a file hard-bounce on your first send, we credit replacement records under the refund policy. That guarantee, and the redelivery of a file that will not download, are your remedies for data quality.

If you dispute a charge with your bank instead of contacting us, we may suspend your account and downloads while the dispute is open. If the dispute is decided in your favor, your license to the files in that order ends and you must delete them.

Agents change brokerages, phones and email addresses every month. We build every edition from the sources described on our sources pages, verify emails with independent services and record the source and check date on every row, but we do not promise that every record is current, complete or error-free. Apart from the bounce guarantee and the promises in these terms, the files and the site are provided "as is", without warranties of merchantability, fitness for a particular purpose or non-infringement, to the extent the law allows.

To the extent the law allows, we are not liable for indirect, incidental, special or consequential loss, lost profits, lost revenue or lost data, or for any fine, penalty or claim arising from how you contact people. Our total liability for any claim relating to the site or the data is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

You will defend and indemnify us against claims, fines and costs arising from your use of the data, including emails, calls and texts you send and any breach of these terms or of the laws listed above.

We may suspend or end your access if you break these terms, including the resale and compliance rules. If we end your license for a breach, you must stop using and delete the data. Sections on ownership, prohibited use, compliance, liability, indemnity and governing law survive termination.

These terms are governed by the laws stated in your order confirmation, without regard to conflict of laws rules. Before starting any formal dispute, contact us so we can try to resolve it within 30 days.

We may update these terms; the date at the top shows the latest version. The version in force when you placed an order applies to that order. Changes for active subscriptions take effect at the next renewal after we email you.
